YOU MUST RESPOND WITHIN EIGHTEEN (18) DAYS FROM THE DATE OF MAILING.

Your response must be filed online by the due date. Failure to pay, appear at a hearing requested for the purpose of contesting the determination or for the purpose of explaining mitigating circumstances may result in refusal of the department of licensing to renew the vehicle registration, until any penalties imposed have been satisfied. RCW 46.63.060(2)(i).

HEARING OPTIONS::  The court may allow a payment plan or reduce the penalty where allowed by law, RCW 46.63.110(6). To request any hearing type or pay go to www.zerofatality.com

MITIGATION::  You agree that you committed the infraction but want a hearing to explain the circumstances. You may not subpoena witnesses. The Judge may reduce the penalty based on mitigating circumstances shown at the hearing.

CONTESTED::  I did not commit the infraction and want to contest this violation in person. The City has the burden of proving by a preponderance of the evidence that an infraction was committed. You may subpoena witnesses, including the officer who issued the infraction. Subpoena requests must be submitted in writing to:

You may request to waive your presence in court and have your ticket examined in chambers by a judicial officer. You must choose if you want a mitigation or contested hearing, the same rules listed above for an in person hearing apply except there is no appeal permitted from a decision on written statements, IRLJ 3.5. STOLEN / SOLD VEHICLE:


If your vehicle was stolen or sold prior to the date & time of the violation, you must provide the court with a confirmed Sellers Report from DOL or if stolen a copy of the police report.

If your vehicle was not in your care, custody or control at the time of the violation, you may submit a certified Declaration of Non-Responsibility to the Court to rebut the presumption, established in RCW 46.63.170(1)(e) and 46.63.075, that you, as the registered owner, were driving the vehicle at the time of the violation. You may obtain the Declaration of Non-Responsibility as follows:

EMPLOYER OWNED VEHICLES:


If you are an employer, YOU ARE RESPONSIBLE and accountable for any negligent acts of the agent or employee. A declaration of non-responsibility may not be used by employers to transfer responsibility to their employees. A vehicle registered to an employer that is driven by an employee remains in the "care, custody and control" of the employer and thus, the employer is responsible for payment of the infraction penalty or requesting a hearing.

RENTAL AGENCIES:


If you are a registered Car Rental Agency, you may submit the name and address to whom the vehicle is leased online at www.zerofatality.com If you are a Car Dealership and this vehicle has been sold, please submit the name and address to whom the vehicle was sold at www.zerofatality.com If not, then car dealerships fall under the employer owned vehicles.

WHAT IF I DO NOT PAY THE FINE?
